So dude needs to go to Calgary for a family emergency, ends up fucking 2 turbos, a twin plate clutch and 2 cylinders.

He better pay you every dime of the repair.

What is the story? Is the place he works footing the bill or do you have to wait for numbnuts to make the cash first? It would make sense for the buiseness to pay you and for the employee to owe the buiseness.

Still have a line on that R34 engine?


Fucking kid... put 600km on your car, probibly a guarantee that he put regular gas in it. Have subracing drain the tank just incase.

According to the last "real" conversation I had with the business, the deal was that they would pay for damages and the kid would work it off.

I priced out a new R34 N1 short block from Japan and they arent a bad price at $5000-$6000 cdn shipped. Or just give Mines a call and order one of their engines for a measly $22,000 shipped :blah5: ... ooooor not.

Anyways, im still waiting for news from Canada as to how the business has responded to the news that the engine is toast. I want to know if they will take responsibility for it and how much they are willing to consider another engine is worth. I can find used engines for $3000-$4500... you can see how a new one or building one is worth it.

Sort of,

The N1 engine come with "special N1 internals"... which besides being properly balanced seems to be no different than stock stuff. The N1 block is lighter and stiffer with better cooling. N1 exhaust manifolds are "better" but no one seems to know why, and of course the N1 turbos are all steel and slightly bigger. The N1 water pump is typical "better than stock" and N1 Oil pump has a stiffer spring. And being a R34 engine the cams have slightly different timing but not any bigger than any other RB26 In stock form its a 430 crank hp engine when mapped. But the beauty is it can rev cleanly to its 9000rpm redline.

So... now do i WAIT till i win in court and WAIT till they pay (as having a judgement is no indication of timely payment) to fix the car or just go ahead and fix the car and then recoup the costs as they are paid to me?

I agree... Get this: They "offered" me $2,500 bucks to fix the car as they "couldnt see how" he could cause that much damage in "only" 600kms...

He could have caused a shitload of damage in less then a mile if he beat the piss out of it in a parking lot. Mileage has nothing to do with it. What they said makes as much sense as V8Archie claiming an LM1 makes 270 hp.

Dude, that sucks. Sue them hard. $2500, wtf!? Good thing you covered your ass with that contract you had them sign. Who the fuck are they to tell you how much damage the stupid kid did?

Of all the cars available he took a Skyline GTR to an emergency trip to Calgary, he broke it and now this... Make the stupid fuckers pay.

Threaten criminal charges against the shop and the kid that stole the car. Its not a fiero so the value makes it grand theft auto.

It would fall under "Unauthorized Use of a Motor Vehicle." But then the law gets sketchy, as by dropping your car off at the shop and signing the agreement, you techinally gave them authorization to use the car. You may want to look into the agreement as see if it mentioned a limit to the use, such as time or mileage.

You'd have a hard time holding him at Grand Theft Auto, as the shop had authorization to use it, and he was employeed by them.

I don't think you have much for criminal charges.

Criminal charges aside, the shop is responsible by law for this damage, though it will take court to get it out of them. And since the value exceeds most small-claims judge judy type court's $5000 limit, you'd need to go higher with a lawsuit. If the business owner doesn't cut you a check RIGHT then, he's a fucking idiot. He has no case, and will probably lose his business over it if it lands in court. If in your original agreement the shop owner did not write that the vehicle had this engine damage before you brought it in, he has absolutely no case. Time for a lawsuit.

In Canada things are a little different...

Anything under $25,000 is considered "small claims".

And there is NOTHING that i can charge the kid AND / OR the business with. The only person in this case that can press charges is the business on to the kid.

Will - The $11,000 includes Re/re twin plate clutch, re/re turbos, re/re engine.

Yah I was assuming they were at least close between the two, since Canada is basically our 51st state anyways :thumbleft:

$25,000 is more than enough to cover the damage, so that's good! And in small claims (For the US at least), you do not need to PROVE he did it, just prove that "It is more likely than not" that he did, which in your case would be easy.

I agree, there is nothing that you can officially CHARGE them with (Criminally), but you CAN sue them for damages caused, there is no doubt about that. And you'd be sueing the business, since they take responsibility for their employee.
