It IS NOT probable cause until the cop can prove it. That's where he has to prove beyond a reasonable doubt. Generally it isn't very hard, but I challenge you to find one clean cop that can hold that charge against me, with the above conditions being true. Quite simply, they cannot. It IS legal to own that piece. Just as it is legal to create it, sell it, and otherwise have business dealings with it. It is only illegal when used illegally, or as I said, can be proved that it is directly intended for illegal use (IE, found in the aforementioned subject's dorm).

On a side note, FPS Doug is fucking awesome!

my dad owns a gun shop, he doesnt like to admit it, but i think it makes him real nervous when i work there, cause anytime i get a gun in my hand it just automaticly points to someones head

Actually, that's jack shit. You can't be in possession unless you are possessing it. A crack pipe is mearly an ornament (Until of course it has crack in it).

Residue. The residue of the contraband inside the pipe that the officer conveniently found in your car is contraband. If it's in your car, it's considered to be in your control and custody, even if it got left there by the chick you gave a ride to because you thought she was just nasty enough to give you that hand job.

Or how about the misdemeanor bust for paraphenalia. Sure, it won't stick if a cop locks you up for finding a Chore-Boy in your car, but it just fucked up your weekend.

This is all completely true, we were assuming a clean, never-used piece.

That is also true, unfortunately.
